CANTIAN AI TERMS OF USE

These Terms of Use ("Terms") are a legally binding agreement between you and CANTIAN AI LIMITED ("Cantian AI," "we," "us," or "our") governing your access to and use of Cantian AI websites, mobile applications, AI-assisted content, digital services, paid services, customer support, and related services (collectively, the "Services").

By accessing, downloading, installing, registering for, purchasing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Service Nature and Important Disclaimer

The Services provide content generation, analysis, search, display, interactive, subscription, paid, and other digital services. Content made available through the Services may be generated or assisted by artificial intelligence, automated systems, rules-based systems, and human review.

The Services are provided for personal interest, cultural reference, entertainment, and informational use only. They are not professional advice and do not provide medical, legal, financial, investment, insurance, psychological, safety, employment, personal, immigration, tax, or other regulated professional advice.

You are responsible for independently checking and evaluating all content before relying on it. Except where mandatory law says otherwise, Cantian AI is not responsible for losses arising from your reliance on, use of, interpretation of, sharing of, or decisions based on any Service content, AI-assisted output, generated content, analysis, display result, recommendation, or other Service result.

The Services are provided on an "as is" and "as available" basis. We do not promise that any content will be accurate, complete, current, uninterrupted, error-free, available forever, or suitable for any particular purpose.

2. Eligibility and Accounts

You must have legal capacity to agree to these Terms. The Services are not directed to children under 13. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian where required by law.

You are responsible for keeping your account credentials secure and for all activity under your account, except where caused by our breach of these Terms or applicable law. You may not sell, rent, transfer, lend, or share your account or paid entitlements unless we expressly allow it.

3. AI-Assisted Content

AI-assisted content may be inaccurate, incomplete, repetitive, biased, offensive, inconsistent, or unsuitable for your circumstances. Similar or identical outputs may be generated for different users. We do not guarantee that any output is unique, protectable, non-infringing, or fit for commercial use.

You must not present AI-assisted content as verified fact, professional advice, human authorship, official conclusion, or another person's statement where that would be misleading. If we provide AI-generated or AI-assisted labels, metadata, watermarks, notices, or other indicators, you must not remove, hide, falsify, or misrepresent them where doing so would violate law, platform rules, or third-party rights.

You are responsible for reviewing generated content before using, publishing, distributing, modifying, or commercializing it. You are also responsible for making sure your inputs and outputs comply with applicable laws, these Terms, and third-party rights.

4. User Content

"User Content" means content you submit, upload, enter, generate, save, publish, share, or otherwise provide through the Services, including prompts, text, images, audio, video, profile information, feedback, and support messages.

You represent that you have all rights needed to provide User Content and that your User Content does not violate law, these Terms, or any third-party rights. Do not submit confidential, sensitive, illegal, infringing, or unsafe content unless you have the right to do so and it is necessary for the Service you choose to use.

You retain rights you may have in your User Content. You grant Cantian AI a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, reproduce, process, display, adapt, analyze, and use User Content as needed to provide, operate, secure, improve, enforce, and develop the Services and to comply with law.

If you publish, export, share, or disclose content from the Services, you do so at your own risk and are responsible for any resulting privacy, reputation, commercial, legal, or other consequences.

5. Acceptable Use

You must not use the Services to:

  • Violate any applicable law, regulation, court order, sanctions rule, export control rule, or third-party right.
  • Create, upload, generate, or share illegal, abusive, hateful, violent, sexual, exploitative, deceptive, defamatory, infringing, or otherwise harmful content.
  • Commit fraud, impersonation, phishing, spam, manipulation, harassment, unlawful surveillance, or misleading commercial activity.
  • Use outputs as the sole basis for high-impact decisions affecting health, safety, finance, employment, housing, education, legal rights, or similar matters.
  • Reverse engineer, scrape, crawl, copy, benchmark, overload, interfere with, bypass, or attack the Services, models, systems, security measures, or rate limits.
  • Use the Services to develop competing models or services, unless permitted by law and our written consent.
  • Remove, hide, falsify, or misuse AI-generated content notices, ownership notices, security features, or attribution information.

We may refuse, remove, restrict, suspend, or terminate access to content, features, entitlements, or accounts if we reasonably believe there has been a violation of these Terms, law, third-party rights, payment rules, or platform safety rules.

7. Intellectual Property

We and our licensors own the Services, including software, interfaces, designs, trademarks, logos, databases, systems, models, workflows, templates, documentation, and platform content. Except for rights expressly granted in these Terms, no rights are transferred to you.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal or internal business use. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Services except as permitted by law or by us in writing.

8. Privacy

Our collection and use of personal information is described in the Cantian AI Privacy Policy: /ja/privacy.

9. Third-Party Services

The Services may link to or rely on third-party services, including app stores, payment providers, cloud services, analytics services, content safety tools, login providers, and communication tools. Third-party services are governed by their own terms and policies. Except where mandatory law says otherwise, Cantian AI is not responsible for third-party services, content, fees, failures, security, privacy practices, or disputes.

10. Service Changes and Availability

We may update, modify, suspend, limit, discontinue, or remove any part of the Services, including features, content, models, integrations, pricing, entitlements, and availability. We do not guarantee that any Service, content, entitlement, history, or feature will remain available forever.

11. Disclaimers

To the fullest extent permitted by law, the Services and all content are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

You use the Services at your own risk. We do not guarantee that the Services will be secure, uninterrupted, free of harmful components, compatible with your device, or available in every location.

12. Limitation of Liability

To the fullest extent permitted by law, Cantian AI will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, revenue, goodwill, data, opportunity, reputation, emotional distress, business interruption, or third-party claims, even if we were advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim relating to the Services or these Terms will not exceed the amount you paid for the specific Service giving rise to the claim during the three months before the event giving rise to liability. If the Service was free, our total liability will not exceed USD 100.

Some jurisdictions do not allow certain disclaimers or limitations. In those jurisdictions, the limitations apply only to the maximum extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnity

You will defend, indemnify, and hold harmless Cantian AI, its affiliates, directors, officers, employees, contractors, partners, and agents from claims, losses, liabilities, damages, costs, and expenses, including legal fees, arising from your User Content, misuse of the Services, violation of these Terms, violation of law, violation of third-party rights, or misuse of AI-generated or AI-assisted content.

14. Termination

You may stop using the Services at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, created risk, caused harm, abused payments or refunds, infringed rights, or used the Services unlawfully. Upon termination, your right to use the Services ends, but provisions that by nature should survive will survive, including payment obligations, intellectual property, disclaimers, limitations of liability, indemnity, and dispute provisions.

15. Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law rules, unless mandatory consumer law in your country provides otherwise. If a dispute cannot be resolved informally, either party may bring the dispute before a court of competent jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a new "Last Updated" date. If changes are material, we may provide additional notice as required by law. Your continued use of the Services after the updated Terms become effective means you accept the updated Terms.
